Patenting strategies in the biotech field

Protection of Intellectual Property Rights (IPR) in the sector of medical biotechnology has a different framework than other technology fields. Germany is not an exception from this rule. Generally, patents provide protection to your innovations and allow the commercialisation of the product, but still you will have to consider additional rules for your market launch in the field of medical biotechnology. Before you launch your product into the market, you have to comply with a number of different regulations and norms and have to fulfil the regulatory requirements such as clinical studies - phase I, phase II, phase III, which cost a plenty of your time and money. It is even more complicated to protect your IPR's if you plan to launch a product in different markets. That means for you that you will have to comply with different national regulations on the one hand and reveal the information on your innovation even in more countries as a result of a patent registration on the other. Thus, biotech companies require a well-planned patenting strategy which answers these and a number of other questions before the decision on the patenting is made. If you develop an innovative production process, in some cases it makes sense to implement a non-disclosure strategy. In contrast an innovation in form of a new product shall be patented which will provide you a higher level of protection.
